Bidding to Buy Upper Crust Pizzerias: Ex-Workers — and their Attorney

Reported to be among the bidders at tomorrow's auction for the bankrupt pizza places: both ex-workers (+ their lawyer) and ex-managers.

  The attorney who represents ex-employees in a class-action lawsuit is among the bidders at tomorrow's auction for 10 Upper Crust locations. The pizza chain went under in October, with, says the Boston Herald, debt of $3-4 million. The Herald writes: The company sought bankruptcy protection after it defaulted on bank loans, the U.S. Labor Department forced it to pay $342,000 in back wages to 121 employees, and several lawsuits were filed against it. Some of those same employees, along with their lawyer, are among bidders for the bankrupt company, according to the Boston Globe.  The Globe quotes attorney Shannon Liss-Riordan, who represents workers in their suit, as saying: The plan is for employees to have ownership shares, and we are …

Upper Crust Pizzeria Files for Bankruptcy Protection

The chain of gourmet pizza restaurants, which has a location in Coolidge Corner, filed for bankruptcy and reportedly owes $3.4 million to creditors.

The Upper Crust Pizzeria chain has filed for bankruptcy protection after defaulting on millions of dollars in loans, according to the Boston Globe. The embattled gourmet pizza chain was ordered by the Federal Labor officials to pay overtime to employees, and has been accused of improper use of assests for personal use by executives, and recently shut down some locations, including the Commonwealth Avenue location which has since been replaced with an Otto Pizza.  The Boston-based company defaulted on a loan to TD Bank in September, and owes $3.4 million to creditors, according to the Globe story. New Scandal Emerges; Do You Still Eat Upper Crust Pizza? [POLL]

In 2010, Upper Crust Pizzeria faced accusations of significant labor violations. Now the chain's founder has been placed on leave after allegations he stole company funds.

One of Upper Crust Pizzeria's founders, Jordan Tobins, has been placed on leave after the other two founders, Josh Huggard and Brendan Higgins, allege he stole money from the company for personal use, according to an article in the Boston Globe.   One thing he might have spent the money on? His $700,000 yacht, which after an attempt to list it on eBay, he is currently barred from selling due to a restraining order that requires him to obtain court approval before transferring any of his personal assets.   The restraining order stems from a lawsuit wherein 5 former employees are suing Upper Crust for labor violations; per the Globe "Upper Crust allegedly relied on low-paid illegal laborers from a small village in Brazil to expand the chain …

I stopped eating Upper Crust not because of their business practices but because their pizzas are overrated and overpriced, and the delivery service has been terrible - my pizza has twice arrived burned, cold, and an hour and a half late. I'll never eat there again.   more ›

Salem and Beverly Upper Crust Locations Closing

The Coolidge Corner pizzeria remains, while two of its sister sites close in Salem and Beverly.

The Upper Crust chain is shrinking a little, but its Coolidge Corner restaurant will remain where it is for now.  On the chain's Facebook page, they confirmed that the two locations will close, directing customers to its other locations in Lexington, Newburyport, and Portsmouth, NH. The Boston Restaurant Talk blog posted both the Salem and Beverly locations shuttered their doors, adding that the latter location had only opened in January of 2011.  A reason for the closure was not immediately available. The business was in operation as recently as last week, Salem Patch reported on Monday. The Upper Crust location in Salem has already closed. The chain made news in June of 2011, when the company was ordered to pay $80K in back wages as well…
