Brookline Police responded to a report of suspicious activity near Westbourne Terrace at about 1:29 a.m. on July 20.

Officers found both doors of the apartment locked, but a window on the side closest to 120 Westbourne Terrace was wide open. Officers went inside and cleared the apartment, finding no one inside.

The black leather couch under the open window had two footprints clearly visible on the right side cushion. The prints came from someone climbing in the window, and were made by flat-soled shoes. A cabinet door was left open in the bathroom and various other items were scattered around.

At this point, officers interviewed the callers, who said that they heard someone rattling a doorknob and a window open. The caller said that she also heard something fall.

Officers searched the area for any suspicious persons and found a man walking towards Westbourne Terrace. Officers saw the man was wearing Converse sneakers. The man told police that he was coming from a friend’s house near Coolidge Corner, then said the house was closer to Beacon and St. Paul’s Street. The man said that he was heading to his place in Allston. Officers asked why he would take such an indirect route with so many hills. The suspect did not answer.

At this point, the officer handed the man a Miranda Warning card, which the suspect read aloud. Officers observed an open wound on the man’s shin. The man told police that he worked as a lifeguard and cut it in the pool. Officers were suspicious of this because of the lack of scabbing on the wound.

Officers charged Maximlian Sass, 19, of 23 Westbourne Terrace with breaking and entering at night with intent to commit a felony. Officers searched Sass’s backpack and found a grinder with a small amount of marijuana, an iPhone which he told police he found in Cambridge, and three Aderal pills. Officers also found a fake ID from Georgia in Sass’s wallet.

In total, Sass was charged with breaking and entering at night with intent to commit a felony, possession of a Class E substance and carrying a false liquor identification.
