Milton Man, Allston Woman Arrested on Drug Charges

Brookline Police make arrests after traffic stop on Kent Street.

Two people were arrested on Sunday morning on drug charges with one also facing an OUI charge.

Catherine Burns, 34, of Allston, was arrested on March 8, and charged with OUI liquor and possession of a Class D substance with intent to distribute. She was also cited for failure to stop. Armond Smikle, 31, of Milton, was arrested and charged with possession of a Class D substance with intent to distribute.

At around 3 a.m. while driving on Kent Street, an officer reported seeing a Honda drive through a red light at the street’s intersection with Longwood Avenue. The officer pulled the vehicle over near Marshal Street.

The officer approached the vehicle and asked the driver, Burns, for her license and allegedly “could immediately smell a strong odor of alcoholic beverage emanating from Burns.” The officer also alleged that her “speech was slightly slurred and her eyes were bloodshot red and glossy.” The officer questioned Burns about whether or not she had been drinking and she said she was at a “Boston thing” earlier; Smikle said he was in Dorchester.

The officer went to check their licenses and alleged that they were “making constant movements by turning their upper torso towards the back seat of the car and reaching downwards in the vehicle.” Smikle was also told to stay in the car but at one point, allegedly opened his door.

Other officers arrived at the scene to assist and one allegedly smelled fresh marijuana. The officer asked if there were drugs in the car and later, 2.9 ounces of marijuana were allegedly found in the center console of the vehicle.

Both Burns and Smikle were separated. Both allegedly told officers the two had only been dating for a few days. When asked if there were more drugs in the car, Burns allegedly stated that there could be.

Burns was given field sobriety tests and was arrested. Smikle was also arrested.

While being processed, Burns agreed to a chemical test.

No other drugs were found in the vehicle after a K-9 unit search but a “plastic and hollow” smoking device was found and seized.
